New Delhi, 30 October 2026 – The Supreme Court of India has issued notice in a Special Leave Petition concerning a prolonged dispute involving homebuyers and DLF Homes Panchkula Pvt. Ltd. The proceedings raise significant legal questions about the Doctrine of Merger, judicial finality and the binding effect of earlier judicial orders.
The case, Vikesh Chanana & Ors. v. DLF Homes Panchkula Pvt. Ltd. & Ors., SLP (C) No. 36522/2026, was heard by a Bench comprising Justice Prashant Kumar Mishra and Justice Shree Chandrashekhar.
The petition arises from a judgment dated 24 July 2026 passed by the Delhi High Court in CM(M) No. 1248/2022.
Advocate Sudhir Kathpalia Raises Key Legal Questions
Advocate Sudhir Kathpalia, appearing for the petitioners, presented legal submissions concerning the Doctrine of Merger and the finality of judicial decisions.
The petitioners have questioned whether subsequent proceedings could lawfully reopen issues in a manner that, according to their submissions, undermines the binding effect of an earlier Supreme Court order.
The matter brings into focus the importance of consistency in judicial proceedings and the legal principles governing the implementation and finality of court orders.
A Prolonged Legal Dispute for Homebuyers
The dispute traces its origins to 2017 and has involved an extended legal journey for the affected homebuyers.
For homebuyers involved in complex real estate litigation, the case highlights the significance of judicial remedies, contractual obligations and the need for clarity regarding the legal consequences of earlier court decisions.
The proceedings also raise broader questions about judicial discipline and the extent to which concluded matters may be revisited through subsequent litigation.
Supreme Court Directs Issuance of Notice
After hearing the submissions, the Supreme Court directed that notice be issued, returnable on 11 December 2026.
Senior Advocate Pinaki Mishra appeared for DLF. The respondent's Advocate-on-Record accepted notice and undertook to file a counter-affidavit within four weeks.
The matter is now pending further consideration before the Supreme Court.
